Acceptance of terms

By accessing this website or engaging Elions Logistics for any service, you agree to these Terms & Conditions. If you do not agree with them, please do not use this website or our services.

Services provided

Elions Logistics provides truck dispatching, freight forwarding, MC authority leasing, truck rental, driver and truck recruitment, and optional factoring paperwork support. We act as a service provider to motor carriers. We are not a motor carrier for the purposes of freight we dispatch on your authority, and we do not take possession of freight.

Client responsibilities

You are responsible for maintaining valid operating authority, current insurance at the limits required by your customers and by law, and compliance with all FMCSA and DOT regulations including hours of service. You are responsible for the safe and lawful operation of your equipment and for the conduct of your drivers.

You agree to provide accurate information about your authority, insurance and equipment, and to notify us promptly if any of it changes.

Dispatch fees and payment

Dispatch fees vary by equipment type and are quoted to you before service begins. Fees are agreed in writing before any load is booked on your behalf. We do not deduct fees from money owed to you by brokers or shippers unless separately agreed in writing.

Load approval

No load is booked on your equipment without your approval of the rate. You may decline any load for any reason.

Cancellation

Either party may end the service relationship with written notice. Loads already booked and confirmed at the time of cancellation will be completed, and any fees earned on those loads remain payable.

Limitation of liability

To the fullest extent permitted by law, Elions Logistics is not liable for indirect, incidental, consequential or punitive damages arising from the use of our services, including lost profits, missed loads, cargo claims, detention not recovered, or broker non-payment. Our total liability for any claim is limited to the dispatch fees you paid us for the load giving rise to the claim.

Nothing in these terms excludes liability that cannot be excluded by law.

Third-party brokers and carriers

We negotiate with freight brokers and shippers on your behalf. We check broker credit where information is available, but we do not guarantee that any broker or shipper will pay, perform, or honour agreed terms. Contracts for the movement of freight are between you and that broker or shipper.

All content on this website, including text, layout, graphics and logos, is the property of Elions Logistics and may not be reproduced without permission.

Governing law

These Terms & Conditions are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any dispute arising under them is subject to the exclusive jurisdiction of the courts of the State of Wyoming.

Changes to these terms

We may update these Terms & Conditions from time to time. The date at the top of this page reflects the most recent revision. Continued use of our services after a change constitutes acceptance of the revised terms.
